These Terms and Conditions apply to the sale of tickets for the Elements Winter Festival and Elements Festival 2022.
By purchasing a Ticket for the Elements Winter Festival and/or Elements Festival 2022, you agree to be legally bound by these Terms and Conditions, just as if you had signed a written agreement. If you do not agree with any part of these Terms and Conditions, you should not purchase a Ticket nor attend the Elements Winter Festival or Elements Festival 2022.
Tickets sales are final and binding. Ticket Holders are not entitled to a refund, regardless of any changes in personal circumstances. The Promoter will not replace stolen, lost, damaged or destroyed Tickets.
If your ticket has been canceled, damaged or defaced, you may be refused entry to the Festival. If it has already been scanned or does not appear in the Front Gate scanner system, you may also be refused entry.
The Promoter reserves the right to change, without notice, the Festival artist line-up at its discretion. This includes the dates of the Festival, entry and exit times, number of stages, number of artists, performance times, special effects, amenities, amount and/or type of market stalls, Festival programme, layout of camping ground, layout of the Festival Site, and any other facilities and attractions associated with the Festival (jointly “Facilities and Attractions”). The Promoter shall not be required to provide whole nor partial refunds, nor any other compensation to Ticket Holders if the Facilities and Attractions are changed.
The Promoter is not required to give whole nor partial refunds, nor other compensation to Ticket Holders if poor or difficult weather is experienced prior to, during, or after the Festival.
The Promoter reserves the right to cancel the Festival, at any time, in the case of any “Force Majeure Event”. This includes anything outside the Promoter’s control which, at the Promoter’s sole discretion, makes it logistically impossible to operate the Festival. This includes, without limitation: rain, flooding, drought, storms, lightning, drought, any other form of bad weather, fire, acts of God, explosions, sabotage, accidents, labour disputes, council or police rulings, war, zombie apocalypse and damage to the Festival site from any Force Majeure Events.
The Promoter equally reserves the right to shorten the Festival’s duration, at any time, due to a Force Majeure Event.
If the festival can not take place on the planned dates for any reason, including bushfire, inclement weather, pandemic, Covid-19 restrictions, or any other exceptional circumstances, the festival will be postponed and all festival tickets will be valid for the new festival dates. If the ticket holder can not attend the festival on the new dates, you will have the choice to on-sell your ticket (to enter the festival, the ticket must have a name change so the name on the ticket reflects the name of the new purchaser) or request a refund by emailing info [at] elementsfestival.com.au. Name changes can be organised by contacting support [at] beatbase.com (Beatbase Ticket Support). The service comes with a $20 fee and is available until 11pm Tuesday 31st May for Winter Festival and 11pm Tuesday the 11th of October for Spring Festival.
Conduct of Ticket Holders
You agree to follow all directions given by Festival Staff, at all times, throughout the Festival.
Community-minded behaviour is expected at all times. This includes your journey to the Festival, the Festival itself, and your journey home. Persons deemed by the Promoter to be behaving in a dangerous or unacceptable manner may be refused entry, evicted from the Festival Site and/or reported to the local authorities.
The environment and the local community are of paramount importance to the Promoter. Please share this respect and place any litter you create or find in the bins available to you around the Festival Site. We thank you for being conscious of waste and conservative with water use.
Access to Festival Site
Your entry to and exit from the Festival Site shall be in accordance with the strict timelines published on the Website. These are subject to change at the discretion of the Promoter.
The Promoter reserves the right to refuse entry to any Ticket Holder if, in its sole discretion, the Promoter believes the Ticket Holder may pose a threat to the security or smooth running of the Festival. If it is determined that a Ticket Holder must be refused entry to the Festival, pursuant to this clause, that Ticket Holder will not, under any circumstance, be entitled to a Ticket refund, nor any other form of compensation.
Ticket Holders are obliged to wear a wristband for the full duration of the Festival. If a person is caught without a wristband, they may, at the discretion of the Promoter, be offered the opportunity to purchase a full-price ticket. The Promoter reserves the right to remove any person who does not have a wristband from the Festival Site.
Any person collecting their Tickets at the Festival gate must provide Festival staff with a valid form of photographic identification. If you do not present this identification, you cannot be confirmed as the Ticket Holder and may be denied entry to the Festival.
As a condition of entry to the Festival, all Ticket Holders must consent to having their vehicles, bags, clothes and other possessions searched by Festival staff prior to entering the Festival site. If you fail to comply with this condition, you breach the Terms and Conditions of your Ticket purchase and may be refused entry to the Festival.
Your Ticket grants you access only to the signed ‘public’ areas of the Festival Site. You agree to stay within these signed ‘public’ areas. Any Ticket Holders found in unauthorised areas of the Site may be removed from the Festival. Ticket Holders found outside the boundaries of the Festival Site will be considered trespassers on the property they are on and will, therefore, be subject to prosecution by local authorities. The Promoter reserves the right to remove any Ticket Holder from the Festival site who does not comply with any of the Terms and Conditions hereunder.
U18 | YOUTH | Minors
All persons under the age of 18 (“Minors”) who attend the Festival must be accompanied by a parent or legal guardian (“Guardians”). Guardians accept full responsibility for the safety and wellbeing of Minors in their care and agree to supervise them at all times during the Festival. Festival entry is free of charge for Minors under the age of 13. General admission prices apply to all Minors above the age of 13. The Terms and Conditions herein apply, in their entirety, to all Minors. Guardians accept responsibility for ensuring Minors in their charge comply with all of the Terms and Conditions. Guardians hereby agree to hold the Promoter and all Festival staff and contractors harmless from any and all liability for loss, liability, claims, demands or expenses (legal fees included) incurred by a Minor in his/her charge, or caused to third parties by a Minor in his/her charge, in the course of that Minor’s attendance of the Festival, or any breach by that Minor of these Terms and Conditions.
Restrictions
A total fire ban is in place for the duration of the Festival. You are not permitted to have campfires, naked flames, candles or other potentially hazardous items or materials.
The possession, use or sale of illegal drugs, or any illicit substances, is strictly forbidden. The Promoter neither condones nor endorses the use of illegal and illicit substances. Any Ticket Holder found with such substances in their possession will be immediately removed from the Festival Site.
The following items are also prohibited on the Festival site. Do not bring any:
- Illegal, menacing or dangerous items;
- Mini-bikes and any similar motorised vehicles;
- Glass bottles, glass containers, breakable drinking glasses;
- Pyrotechnics, sparklers, flares, fireworks or firecrackers;
- Generators or sound systems;
- Dogs or any kind of pets (guide dogs are the only exception).
Any Ticket Holder found with any of these in their possession will be evicted from the Festival Site.
Loss & Damage
You must not improperly use, cause damage to, remove, tamper with or steal any public facility or Festival infrastructure (“Festival Property”). Equally, you must not improperly use, cause damage to, remove, tamper with or steal any element of the Festival Site’s neighbouring properties, nor anything from the local Sunshine Coast Hinterland communities. You take full responsibility for your actions and agree that you shall be held fully liable for any damages or losses caused by you to Festival Property, neighbouring property and property of the surrounding communities.
The Promoter will not be held liable, whatsoever, for any damage to, or loss of, any property (including, without limitation, personal property such as cars, tents, bags, cash or any other personal items) brought to or purchased during the Festival.
The Promoter will not be held liable for any damage, loss, injury, delay or additional expenses incurred by you as a result of a Force Majeure Event (as defined above), shortening of the Festival due to a Force Majeure Event, or complete cancellation of the Festival due to a Force Majeure.
You agree to indemnify and hold the Promoter and all its staff and contractors harmless from any loss, liability, demands, claims or expenses, including legal fees (on a full indemnity basis) made by you, or any third party, against the Promoter, due to, or arising out of, your attendance of the Festival, or any breach made by you of the Terms and Conditions herein.
You indemnify and hold the Promoter and all its staff and contractors harmless from any and all liability for any loss, liability, demands, claims or expenses, including legal fees (on a full indemnity basis) incurred by you, or caused by you to third parties, arising out of your attendance of the Festival, or any breach of the Terms and Conditions herein.
You agree to indemnify and hold the Promoter and all its staff and contractors harmless from any loss or damage, including legal expenses, indirect or consequential loss (on a full indemnity basis) suffered or incurred by the Promoter as a result of, or in any way relating to, your attendance of the Festival, or a breach by you of the Terms and Conditions of this Agreement.
Waiver
You hereby acknowledge the Festival Site and the land it is staged on are inherently dangerous and may contain all manner of risks, hazards and obstacles. These may be known and unknown, natural or manufactured and may result in:
- loss of your property;
- damage to your property;
- personal injury;
- or death.
Knowing this to be the case, if you attend the Festival and enter the Festival Site, you do so at your own risk. You waive and forego any rights to make any claims for losses, damages and injuries. You agree that it is your responsibility to come well prepared to handle any and all challenging situations you may be presented with at the Festival Site.
